THE CONSTITUTIONAL COURT

declares that the question of legittimita'costituzionale dell'articolo 140, comma 4, del decreto legislativo 7 settembre 2005, n. 209 (Codice delle assicurazioni private),sollevata, in riferimento agli articoli 3, 24 e 111, secondo comma,
della Costituzione, dal Tribunale di Catania con l'ordinanza indicata in epigrafe;
Dichiara non fondata la questione di legittimita' costituzionale dello stesso articolo 140, comma 4, del decreto legislativo 7 settembre 2005, n. 209, sollevata, in riferimento all'articolo 76 della Costituzione, dal Tribunale di Catania con la medesima ordinanza.
Cosi' deciso in Roma, nella sede della Corte costituzionale, Palazzo della Consulta, il 21 giugno 2010.
