Nella manovra appena approvata dalla maggioranza non si danno risposte alle questioni che riguardano gli italiani all’estero, si colpisce il Ministero degli Affari esteri con tagli lineari che avranno conseguenze drammatiche su rete consolare, servizi, presenza nel mondo accanto a imprese, cooperazione allo sviluppo e promozione culturale, oltre ai tagli ai capitoli di bilancio per gli italiani nel mondo.
Non viene data risposta alla questione ICI, che interessa tutti coloro che hanno una casa in Italia e sul tema delle detrazioni fiscali per carichi di famiglia, introdotte dal Governo Prodi ed estese anche ai residenti all’estero, che scadono il prossimo anno e necessitano una proroga o il definitivo inserimento nel panorama fiscale italiano, il Governo accoglie l’impegno politico ma sulla realizzazione concreta dice: solo “se le condizioni di finanza pubblica lo consentiranno”.
Ricordo che il Governo aveva già preso impegni sia con la proroga di un anno che con l’accoglimento di numerosi altri ordini del giorno. Ricordo che la questione può essere oggetto di contenzioso internazionale poiché la eventuale esclusione dei residenti all’estero – per decadenza della norma – porrebbe i residenti all'estero, che producono un reddito assoggettabile ad IRPEF in Italia, in una condizione di sostanziale disparità nei confronti dei residenti nel territorio nazionale e non godono, nel Paese di residenza, di benefici connessi ai carichi famigliari.

impegna il Governo

a predisporre un'apposita norma di proroga tesa a superare il limite temporale 2010 e comunque prevedere la definitiva estensione delle detrazioni fiscali per carichi di famiglia ai residenti all'estero.

I requisiti per ottenere le detrazioni sono i seguenti:
le persone per cui si richiedono le detrazioni non devono possedere un reddito complessivo superiore a 2.840,51 euro (al lordo degli oneri deducibili);
il richiedente non deve godere nel paese di residenza di benefici fiscali related to family responsibilities.

Il Governo ha sviluppato ogni possibile approfondimento per poter applicare, anche in via amministrativa, quanto stabilito dalla Corte di cassazione, con la citata sentenza, per ciò che riguarda il riconoscimento in sede giudiziale dello status di cittadino italiano alle donne che si trovano nella condizione citata.
L'esame a tal fine avviato, d'intesa con il Ministero degli Affari Esteri, ha fatto emergere alcuni limiti procedimentali imposti dalla legislazione vigente, dovuti alla necessità di acquisire la dichiarazione di volontà delle donne interessate, secondo quanto stabilito dall'articolo 219 della legge n. 151 del 1975, espressamente richiamato al secondo comma dell'articolo 17 della legge n. 91 del 1992.
Inoltre, la disposizione dell'articolo 15 della medesima legge n. 91 del 1992 - cui fa riferimento anche la sentenza della Corte di cassazione - stabilisce che l'acquisto o il riacquisto della cittadinanza può avere effetto solo dal giorno following that in which they are made of the conditions required by law.

Il decreto Maroni è quella legge che l’attuale governo ha approvato per cercare di mettere ordine nel settore della sicurezza privata.
Il decreto sarebbe dovuto entrare in vigore il 6 Aprile ma vista la necessità di una proroga, l’applicazione di tale legge si avrà il 31 dicembre 2010.
- Che cosa prevede tale decreto?

THE MINISTER OF THE INTERIOR

Given the Law of 1 April 1981, No 121
Seen the Royal Decree of June 18, 1931, No 773, as amended and supplemented;
Seen the Royal Decree of May 6, 1940, No 635 and subsequent amendments and additions;
view of the art. 3 of Act No. 94, July 15, 2009 on "Provisions relating to public safety" and, in particolare, i commi dal 7 al 13 che autorizzano e disciplinano l'impiego di personale addetto ai servizi di controllo delle attività di intrattenimento e di spettacolo in luoghi aperti al pubblico o in pubblici esercizi anche a tutela dell'incolumità dei presenti;
Rilevato che il predetto art. 3 della legge n. 94 del 15 luglio 2009, al comma 9, rinvia ad un decreto del Ministro dell'interno, da adottarsi entro sessanta giorni dall'entrata in vigore della legge, la definizione dei requisiti per l'iscrizione nell'elenco di cui al comma 8 dello stesso articolo, delle modalità per la selezione e della formazione del personale, degli ambiti applicativi e del relativo impiego;

Decreta:

Art. 1.
Requisiti per l'iscrizione nell'elenco e modalità di selezione del personale addetto ai servizi di controllo

1. In ciascuna Prefettura - Ufficio territoriale del Governo è istituito l'elenco del personale addetto ai servizi di controllo delle attività di intrattenimento e di spettacolo in luoghi aperti al pubblico o in pubblici esercizi anche a tutela dell'incolumità dei presenti.
L'iscrizione nell'elenco è condizione per l'espletamento dei servizi predetti.
2. I gestori delle attività di cui al comma 1 possono provvedere ai servizi di controllo direttamente con proprio personale o avvalendosi di personale dipendente da istituti autorizzati a norma dell'art. 134 del Testo unico delle leggi di pubblica sicurezza, approvato con regio decreto 18 giugno 1931, n. 773.
3. La domanda di iscrizione nell'elenco è presentata al Prefetto competente per territorio a cura del gestore delle attività di cui al comma 1 ovvero del titolare dell'istituto di cui al comma 2.
4. L'iscrizione nell'elenco di cui al comma 1 è subordinata al possesso dei seguenti requisiti:
a) età non inferiore a 18 anni;
b) buona salute fisica e mentale, assenza di daltonismo, assenza di uso di alcool e stupefacenti, capacità di espressione visiva, di udito e di olfatto ed assenza di elementi psicopatologici, anche pregressi, attestati da certificazione medica delle autorità sanitarie pubbliche;
c) non essere stati condannati, anche the sentence is not final, not culpable for crimes;

5. In case of loss by a person referred to in Article. 1, paragraph 1, of one or more requirements of this section or if he / she engages in conduct that is contrary con quanto previsto dall'art. 3, commi 7, 8, 9, 10, 11 e 12 della legge 15 luglio 2009, n. 94, ovvero con quanto stabilito dalle disposizioni di cui al presente decreto, fermo restando il disposto del comma 13 dell'art. 3 della citata legge, il Prefetto comunica l'avvenuta cancellazione dall'elenco all'interessato, al gestore delle attività di intrattenimento e di pubblico spettacolo o al titolare dell'istituto di cui al comma 2 per il divieto di impiego nei servizi disciplinati dal presente decreto.

Art. 2.
Revisione biennale

1. Il Prefetto, competente per territorio, provvede ogni due anni alla revisione dell'elenco di cui all'art. 1, al fine di verificare il permanere dei requisiti di cui alle lettere b) c) d) and e) of Article. 1 of the inspection staff. Article 3.

2) area tecnica, con particolare riguardo alla conoscenza delle disposizioni in materia di prevenzione degli incendi, di salute e sicurezza nei luoghi di lavoro, di nozioni di primo soccorso sanitario;
3) area psicologico-sociale, avuto riguardo in particolare alla capacità di concentrazione, di autocontrollo e di contatto con il pubblico, alla capacità di adeguata comunicazione verbale, alla consapevolezza del proprio ruolo professionale, orientation to service and communication in relation to the presence of people with disabilities.

Article 4. Application ranges


1. The provisions of this Decree apply:

Nell'espletamento dei compiti previsti dal presente decreto, il personale di cui all'art. 1 deve essere munito di idoneo documento di identità e tenere esposto un tesserino di riconoscimento, con le caratteristiche di cui all'allegato A del presente decreto, di colore giallo, recante la dicitura «Assistenza» in caratteri facilmente leggibili.

Art. 8.
Norma transient

1.
