This is the serial number that marks one of three hundred copies of a book that prof. Carnelutti is printed during his exile in Switzerland. The command area 9 b, a division of the Swiss press and radio, allow the esteemed scholar, the possibility of publishing two books, a kind of strictly scientific and the other with religious content. The first, which was discovered by me with his file relating to the period of internment in Canton Ticino, at the Library and State Archives of Bellinzona is titled: The problem of pain, and is published by Arturo Salvioni. Report to print the date of publication: October 1943. It is a slim volume of just 80 pages, excluding the index, in which Carnelutti preface warns that the book is published in Bellinzona, but was born in Italy, where he intended to return, and in fact, the publishing house will publish it in Rome Tumminelli in 1945. The concept contained in the work is the overturning of the law of retaliation: the penalty is not equal to that suffered an insult, it can not be regarded as an evil to be added to another. It must seek the restoration of a cert'ordine, should result in the imposition of the offender to live that way, so he can, as soon as possible and as safe as possible, reach the repentance and, with it, regain la libertà.
Nel secondo libro, invece, è palpabile uno spiccato senso della fede e della religiosità, ormai presente in gran parte dei suoi scritti, a partire da: Metodologia del diritto, opera dedicata a Monsignore Giovanni Urbani, che lo accolse in un momento di particolare solitudine, che avvertiva a causa della perdita della sua Rita e di sua madre. Meditazione su L’Ave Maria viene pubblicato a Lugano ed è edito dall’Unione popolare ticinese nel 1944. Nel libricino di appena 64 pagine è sempre presente lo stretto legame tra legge naturale e fede religiosa, un connubio che pervaderà anche la tela di pensieri, si direbbe metagiuridici, di “Il sole si leva al tramonto”. Anche in questo caso l’autore Italian will publish the book to be published first in 1945 by Tumminelli, and again in 1955.
