dedication of the First Comment d. lgv.n.28/2010 regarding the reconciliation of civil and commercial
In implementation art. 69/2009 of 60 LN, with which the Government responsible for the establishment of one or more legislative decrees on civil and commercial dispute resolution, the d. LGV. No 28/2010, is approaching the start-up phase.

Il procedimento ricalca la disciplina del tentativo di conciliazione per il rito lavoristico, (salvo che per i tempi più ridotti), non più obbligatorio, a seguito della modifica introdotta dall’art. 31 del D.D.L 1167/B definito “collegato lavoro”, anche per la parte relativa agli effetti della prescrizione e della decadenza della domanda di mediazione che sono equiparati a quelli della domanda giudiziale e che si producono dalla comunicazione alle altre parti della domanda di mediazione.

Inoltre all’atto di conferimento dell’incarico, l’avvocato deve informare la parte della possibilità di avvalersi del procedimento di mediazione e delle agevolazioni fiscali previste, oltre ai casi in cui il procedimento è condizione di procedibilità della domanda giudiziale, la mancata informazione è causa di nullità del contratto tra l’avvocato e l’assistito.
Degno di attenzione è anche l’intento del legislatore che all’art 21 del decreto delega al Ministro della giustizia la divulgazione al pubblico anche attraverso internet, di informazioni sul procedimento di mediazione e sugli organismi abilitati a svolgerlo, questo consentirà a ciascun cittadino di prendere coscienza di ulteriori (e non direi alternativi) strumenti di tutela dei propri diritti , laddove i tempi biblici della giustizia, i fascicoli accatastati nei tribunali, l’insufficienza delle risorse umane e strumentali degli uffici giudiziari , tendono a negarla.

E m a n a il seguente decreto legislativo:
CAPO I Disposizioni generali
Art. 1
Definizioni
1. Ai fini del presente decreto legislativo, si intende per: a) mediazione: l'attivita', comunque denominata, svolta da un terzo imparziale e finalizzata ad assistere due o piu' soggetti sia nella ricerca di un accordo amichevole per la composizione di una controversia, sia nella formulazione di una proposta per la risoluzione della stessa; b) mediatore: la persona o le persone fisiche che, individualmente o collegialmente, svolgono la mediazione rimanendo prive, in ogni caso, del potere di rendere giudizi o decisioni vincolanti per i destinatari del servizio medesimo; c) conciliazione: la composizione di una controversia a seguito dello svolgimento della mediazione; d) organismo: l'ente pubblico o privato, presso il quale puo' svolgersi il procedimento di mediazione ai sensi del presente decreto; e) registro: il registro degli organismi istituito con decreto del Ministro of Justice under Article 16 of this Decree, as well ', until the adoption of that decree, the Register bodies established by the Decree of the Minister of Justice 23luglio 2004, n. 222.

Art. 13
Spese processuali
1. Quando il provvedimento che definisce il giudizio corrisponde interamente al contenuto della proposta, il giudice esclude la ripetizione delle spese sostenute dalla parte vincitrice che ha rifiutato la proposta, riferibili al periodo successivo alla formulazione della stessa, e la condanna al rimborso delle spese sostenute dalla parte soccombente relative allo stesso periodo,nonche' al versamento all'entrata del bilancio dello Stato di un'ulteriore somma di importo corrispondente al contributo unificato dovuto.Resta ferma l'applicabilita' degli articoli 92 e 96 del codice di procedura civile. Le disposizioni di cui al presente comma si applicano altresi' alle spese per l'indennita' corrisposta al mediatore e per il compenso dovuto all'esperto di cui all'articolo 8,comma 4. 2. Quando il provvedimento che definisce il giudizio non corrisponde interamente al contenuto della proposta, il giudice, se ricorrono gravi ed eccezionali ragioni, puo' nondimeno escludere la ripetizione delle spese sostenute dalla parte vincitrice per l'indennita' corrisposta al mediatore e per il compenso dovuto all'esperto di cui all'articolo 8, comma 4. Il giudice deve indicare esplicitamente, nella motivazione, le ragioni del provvedimento sulle spese di cui al periodo precedente. 3. Salvo diverso accordo le disposizioni precedenti non si applicano ai procedimenti davanti agli arbitri.
Art. 14
Obblighi del mediatore
1. Al mediatore e ai suoi ausiliari e' fatto divieto di assumere diritti o obblighi connessi, direttamente o indirettamente, con gli affari trattati, fatta eccezione per quelli strettamente inerenti alla prestazione dell'opera o del servizio; e' fatto loro divieto di percepire compensi direttamente dalle parti. 2. Art. 15
Mediazione nell'azione di classe

CAPO III
Degli organismi di mediazione
Art. 16
Organismi di mediazione and register. List of trainers

La vigilanza sul registro e' esercitata dal Ministero della giustizia e, con riferimento alla sezione per la trattazione degli affari in materia di consumo di cui al comma 2, anche dal Ministero dello sviluppo economico. 5. Presso il Ministero della giustizia e' istituito, con decreto ministeriale, l'elenco dei formatori per la mediazione. Il decreto stabilisce i criteri per l'iscrizione, la sospensione e la cancellazione degli iscritti, nonche' per lo svolgimento dell'attivita' di formazione, in modo da garantire elevati livelli di formazione dei mediatori. Con lo stesso decreto, e' stabilita la data a decorrere dalla quale la partecipazione all'attivita' di formazione di cui al presente comma costituisce per il mediatore requisito di qualificazione professionale. 6. L'istituzione e la tenuta del registro e dell'elenco dei formatori avvengono nell'ambito delle risorse umane, finanziarie e strumentali gia' esistenti, e disponibili a legislazione vigente, presso Ministry of Justice and the Ministry of Economic Development, for the part of their jurisdiction, and, anyway, without new or higher charges for the state budget. Alla copertura degli oneri derivanti dalle disposizioni dei commi 2 e 3, valutati in 5,9 milioni di euro per l'anno 2010 e 7,018 milioni di euro a decorrere dall'anno 2011, si provvede mediante corrispondente riduzione della quota delle risorse del Fondo unico giustizia di cui all'articolo 2,comma 7, lettera b)del decreto-legge 16 settembre 2008, n. 143, convertito, con modificazioni, dalla legge 13 novembre 2008, n. 181, che, a tale fine, resta acquisita all'entrata del bilancio dello Stato. 9. Il Ministro dell'economia e delle finanze provvede al monitoraggio degli oneri di cui ai commi 2 e 3 ed in caso si verifichino scostamenti rispetto alle previsioni di cui al comma 8,resta acquisito all'entrata l'ulteriore importo necessario a garantire la copertura finanziaria del maggiore onere a valere sulla stessa quota del Fondo unico giustizia di cui al comma 8.

1. attuazione dei principi previsti dal decreto legislativo 7 marzo 2005, n. 82, e successive modificazioni. Le vigenti regole tecniche del processo civile telematico continuano ad applicarsi fino alla data di entrata in vigore dei decreti di cui ai commi 1 e 2.
2. Nel processo civile e nel processo penale, tutte le comunicazioni e notificazioni per via telematica si effettuano, mediante posta elettronica certificata, ai sensi del decreto legislativo 7 marzo 2005, n. 82, e successive modificazioni, del decreto del Presidente della Repubblica 11 febbraio 2005, n. 68, and technical regulations imposed by the decrees provided for in paragraph 1.
